PLEASE NOTE THAT IN ADDITION TO THESE INCENTIVE PROGRAM TERMS AND CONDITIONS (“INCENTIVE TERMS”), THE AIRBNB TERMS OF SERVICE, THE AIRBNB PLUS TERMS AND CONDITIONS AND PAYMENTS TERMS OF SERVICE AGREED TO BY YOU AS A USER OF THE AIRBNB PLATFORM (COLLECTIVELY, “AIRBNB TERMS”), APPLY TO YOUR PARTICIPATION IN THIS INCENTIVE PROGRAM. PLEASE REVIEW THESE INCENTIVE TERMS IN THEIR ENTIRETY BEFORE PARTICIPATING IN THE PROGRAM. COLLECTION AND USE OF PERSONAL INFORMATION IN CONNECTION WITH YOUR PARTICIPATION IN THE PROGRAM IS SUBJECT TO AIRBNB’S PRIVACY POLICY.

Summary Description of the Program

As more fully set out below in these Incentive Terms, the Airbnb Plus Incentive Program (the “Program”) offers eligible Airbnb hosts (a “Host”) who have applied to have their property listing (“Listing”) included in the Airbnb Plus program a monetary incentive to complete the items on the Host’s Fix Report (“Fix Report”). The amount of the offered incentive payment (the “Incentive Payment”) will be determined by Airbnb in its discretion based on the Host’s Fix Report. The Incentive Payment will be paid only after Airbnb confirms that the Host has satisfactorily completed all fixes to their property listing as stated on their Fix Report. Airbnb has sole discretion to withhold the Incentive Payment if the Program conditions are not met.

Eligibility Criteria

To be eligible to participate in the Program, you must meet each of the following requirements (collectively the “Eligibility Criteria”).

You must be a Host in good standing who has:

• applied to the Airbnb Plus program;
• received an inspection by an Airbnb partner related to participation in the Airbnb Plus program;
• received a Fix Report; and
• received an offer to participate in the Program.

In addition, your Listing must:

• be active and have had at least three completed bookings over the past 365 days;
• have a minimum of three photographs;
• have at least a 4.75 overall rating over the past 365 days; and
• have zero ‘Cancelled by Host’ instances in the past 365 days.

Program Procedures and Deadlines

1. The Program is initiated when you receive an offer from Airbnb to participate in the Program (“Program Offer”), which will tell you the specific Incentive Payment you will receive if you complete the Program conditions.
2. Airbnb will initiate the Incentive Payment to the account connected to your Listing within 5 business days after Airbnb confirms that you have completed all items in your Fix Report, so long as you have done so within 21 days after receiving the Program Offer (the “Offer Window”).

Program Conditions

Hosts must complete all Fix Report items within the Offer Window to Airbnb’s satisfaction. Hosts should provide photographs or other information to establish that each Fix Report item has been completed. Such information must be submitted according to the instructions in the Airbnb email confirming your participation in the Program.

If not all Fix Report items are completed within the Offer Window to Airbnb’s satisfaction, Host understands and agrees that Airbnb may decline to make the Incentive Payment.

If a participating Host does not complete all Fix Report items by the Offer Window to Airbnb’s satisfaction, but the Host can provide information demonstrating that he or she has made substantial compliance in good faith or will shortly complete all Fix Report items, the Host may contact Airbnb by responding to the Program Offer email and request that Airbnb exercise its discretion to make part of the Incentive Payment. Airbnb has no obligation to respond to or grant any such request.

The Incentive Payment offered to each Host will be determined by Airbnb in its sole discretion.

Participation in the Program does not guarantee that any Host or any Listing will be accepted into the Airbnb Plus program. Failure to be accepted into the Airbnb Plus program does not impact the terms of this Program.

Please check your local laws to confirm your eligibility to participate in this Program and that listing your property on Airbnb is in compliance with applicable local laws, including any short term rental laws or registration and any other legal obligations you may be under.

The Airbnb Terms apply as to any taxes applicable to an Incentive Payment.

Program Term and Termination

You will be eligible for the Program if you receive an offer from Airbnb and meet all the Eligibility Criteria. If you fail to fulfill the Program Conditions by the required dates, your enrollment in the Program will terminate.

This program is offered for a limited time only and terms are subject to change at any time. If Airbnb elects to terminate the Program, we will post a message on this page that the Program is no longer in effect.

The Program will be available until it is terminated by Airbnb for any reason (the “Program End Date”). If the Program End Date occurs prior to the end of your Offer Window, the Program will terminate as to you on the Offer Window. Your warranties and other promises in these Incentive Terms will continue to apply and survive the Program End Date.

If the Program is terminated, unless you take action to close your account you will remain enrolled in the Airbnb service, although the Program will no longer apply to you.

Additional Incentives and Programs

From time to time, Airbnb may publicize additional incentives and programs applicable to particular markets or hosts. Such announcements will include specific information regarding the requirements for receiving such incentives in that market.

This Program may not be combined with other Airbnb programs or incentives which reward you for completing the items on a Fix Report.

Nature of Relationship

You acknowledge and agree that it is a fundamental term and condition precedent of your participation in the Program that you are an independent individual and not an employee, intermediary or agent of Airbnb, and that you will not hold yourself out as, or give any person reason to believe, that you are an employee, intermediary or agent of Airbnb. You agree that nothing in your participation will be construed as establishing an employment or agency relationship between Airbnb and you (apart from your appointment of Airbnb Payments as your limited payment collection agent pursuant to the Payments Terms of Service). Accordingly, you have not at any time been and are not entitled to, and hereby irrevocably waive any right or claim to, the benefits provided by Airbnb to its employees from time to time, including vacation time, benefits, salary, bonus, stock or stock options, profit sharing, insurance, or medical and health benefits. Airbnb will not carry any liability or other insurance on behalf of you or in your favor.

You acknowledge that you, and not Airbnb, are responsible for: (i) any Listing created, activated or offered by you in the course of the Program or otherwise on the Airbnb platform, (ii) any content posted regarding such Listing; and (iii) any bookings resulting therefrom. For the avoidance of doubt, Airbnb shall not review and/or provide any editorial input in relation to any property listing created by you or the content in any such listing.

Warranties

You represent and warrant that: (i) you have all necessary consents and permits to participate in this Program, including those relating your Listing on Airbnb; (ii) you have no pre-existing obligations or commitments (and will not assume or otherwise undertake any obligations or commitments) that would be in conflict or inconsistent with or that would hinder your performance of your obligations under these Incentive Terms or any incorporated document; (iii) you will fully comply at all times with these Incentive Terms, the Airbnb Terms and all applicable laws; (iv) all representations you have made to Airbnb relating to your participation in this Program are truthful; and (v) your participation in the Program will not infringe on any rights of Airbnb or any third-party.

Indemnity

You will defend, indemnify and hold Airbnb harmless from and against all claims, damages, liabilities, losses, expenses and costs (including reasonable fees and expenses of attorneys and other professionals) arising out of or resulting from your negligence or intentional misconduct with respect to your participation in the Program.

Exclusion and Limitation of Liability

IN NO EVENT WILL AIRBNB BE LIABLE FOR ANY SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES OF ANY KIND IN CONNECTION WITH THE PROGRAM OR THESE INCENTIVE TERMS, EVEN IF INFORMED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL AIRBNB’S AGGREGATE LIABILITY TO YOU IN ANY WAY RELATED TO OR CONNECTED WITH THESE INCENTIVE TERMS EXCEED THE TOTAL AMOUNT OF INCENTIVE PAYMENTS MADE TO YOU.

Modification

Airbnb may modify, discontinue or suspend this Program or change these Incentive Terms (including the Eligibility Criteria) at any time for any reason. If you continue to participate in the Program after any such modification or change, your continued participation is deemed to be your acceptance of the modification or change. If any modification or change is not acceptable to you, your only recourse is to end your participation in the Program. After the Program terminates or expires, you will remain enrolled in the Airbnb service.

General

If one or more provisions of these Incentive Terms are found to be invalid, this will not affect the validity of the remaining provisions, which will continue to apply. Any provision which is found to be invalid will be replaced with a provision that comes as close as possible to the purpose of the invalid provision; the same will apply to any omissions within these Incentive Terms.

If Airbnb suspects or determines, in its sole discretion, that you have committed fraud, tampering, or violated the Incentive Terms or Airbnb Terms, Airbnb reserves the right to any remedy, including but not limited to: disqualifying you from participation in this Program or the Plus program; deactivation of your Listing(s), bookings or account; repayment of the Incentive Payment to Airbnb by way of deduction from revenues you earn on Airbnb.
